Outsourcing of Labor protection and Fire Safety

Employers are obligated to establish labor conditions at the workplace in each structural subdivision in accordance with regulatory legal acts and ensure compliance with legislation regarding employee rights in labor protection. The initial step is to determine the labor protection service, which depends on the number of employees in the company:

Less than 20 employees: The employer, possessing appropriate qualifications and knowledge, can independently perform the functions of an occupational safety engineer or engage a third-party specialist on a contractual basis.

Less than 50 persons: The functions of the labor protection service may be performed by a person on a part-time basis, or by a specialist from the technical department concurrently with their main duties.

50 or more employees: The employer must establish a labor protection service, which must include at least 1 full-time specialist. Combining the position of a labor protection engineer with any other functions is not permitted.

Features of Labor Protection and Fire Safety

Often, employers assign the functions of a labor protection specialist on a part-time basis to individuals without appropriate qualifications or engage specialists with low competence, experience, and motivation. Ukrainian legislation is rather imperfect and contradictory, with many regulatory documents being outdated and not optimized, sometimes even contradicting each other. Simply having the desire to work alone is insufficient to understand all the nuances. To effectively build a labor protection management system, a certain knowledge base and practical skills are necessary. Errors by such workers become apparent when there is no time to rectify them (e.g., accidents, labor protection violations), and authorities initiate procedures to hold the responsible parties, primarily the employer, accountable under the law (fines ranging from one hundred untaxed minimum incomes of citizens to imprisonment for up to 8 years).

An experienced outsourcing company dealing with occupational health and safety issues can help avoid or significantly reduce such risks. Delegating the functions of a labor protection engineer to another enterprise is possible for staff of up to 20 people, and for larger numbers, part of the work can be done under contract.
